Military Non Freezing Injury Claims

The Ministry Of Defence has a responsibility to ensure the health and safety of their employees.  This also includes providing protection from cold injury or non freezing injury.

If you are a member of the armed forces and have suffered the effects of non freezing injury, you may be able to make a military non freezing injury claim.

Military personnel often have to work in wet and freezing conditions for prolonged periods of time.  This is the time when the risk of developing non freezing injury becomes real.

The MOD is responsible for ensuring that the weather conditions in which the service personnel operate are suitable.  Depending on the weather conditions, they must provide adequate personal protective equipment to the members including gloves, boots, socks and appropriate clothing so they can be protected whilst working in wet and cold weather conditions.

In addition, they must carry out foot inspections on a regular basis to check for signs of cold foot or non freezing injury.  But, it is true that all this does not usually happen.  There are times when members of the armed forces work in harsh weather conditions without appropriate personal protective gear.

If you have suffered from non freezing injury whilst serving in the armed forces, it is essential that you seek expert legal advice and consider bringing a claim.
