Fine for Bassetlaw District Council

While Derrick Baines, 76, of Mellish Road Langold, Nottinghamshire was returning home from shopping on his mobility scooter, on 10 July 2008, a lorry hit him, knocking him to the ground beneath it.

The lorry concerned was on a missed bin collection and was being operated by only a driver, who did not see the incident occur. He however, noticed shopping spilling on the ground behind the lorry and stopped. He found Mr Baines trapped underneath, who when taken to hospital with multiple injuries from the accident, subsequently died from his injuries.

The Nottingham Crown Court heard from the Health and Safety Executive (HSE) that this accident could have been prevented if a reversing assistant had been on the lorry at the time. These big lorries have many blind spots, and need an assistant at the back as a safety measure when they reverse.

The Bassetlaw District Council, of Potter Street, Worksop, pleaded guilty to breaching the Health and Safety Act, Section 3 (1) of 1974, and were fined
£25,000 and ordered to pay costs of £12,987.
