Claim against Simon Dudley

07/12/11: A terminally-ill pensioner has launched a claim against a company as a result of industrial disease; the pensioner hopes to gain £200,000 in compensation.

Malcolm Bogges suffers from malignant mesothelioma attributed to exposure to asbestos while he was working as an engineer for Simon-Dudley from 1959-1977, the Halesowen News reported.

The case, which has been brought to the High Court, is said to be for a six-figure sum claimed from Simon-Dudley as a result of the company’s negligence.

Mr. Bogges claims that he inhaled asbestos while working at the company’s repair shop, as well as while installing appliances for fighting fires, it says in his legal writ.

Mr. Bogges was told in 2008 that he had cancer caused by the asbestos. He suffers from decreasing health and it’s said that he also experiences mental problems due to his diagnosis.

This is not the first incident of this kind as the News & Star have said that James Murray, aged 72, is also seeking damages from the Carlisle City Council as a result of mesothelioma, which he developed while working at the HM Prison Service.
